Non-Comprehensive Annual Maintenance Contract (AMC)
Terms & Conditions
1. Payment Terms
The full AMC amount must be paid in advance at the time of approval or renewal.
2. Scope of Contract
This contract covers service visits only and does not include any spare parts or hardware replacements.
3. Response Time
Service calls will be attended within 48 hours of complaint registration, excluding Sundays, bank holidays, and public holidays.
4. Contract Validity
The AMC is valid for 12 months and includes remote support and/or on-site visits. On-site service will be provided only if the issue cannot be resolved remotely and is applicable only for systems 9th Generation and above (i.e. manufactured in 2019 or later).
5. On-Site Support Decision
The decision to provide on-site support rests solely with us and shall be provided within 24 hours after remote support.
6. On-Demand Visits
Any visit requested outside AMC scope will be chargeable at ₹1500 per visit.
7. Unresolved On-Site Issues
If the issue cannot be resolved on-site, the client will bear chip-level repair/replacement cost for defective components, transportation charges and applicable duties.
8. Exclusion of Spares
This AMC does not include any spare parts. Replacement of faulty components will be charged at actual cost.
9. Addition of Systems
If new computers are added during the AMC period, charges will be calculated pro-rata, and the current month will be charged in full.
10. Data & Software Responsibility
We are not responsible for data loss, software licensing issues, or performance problems.
11. Software Licensing
The client must provide all valid software licenses required for servicing.
12. Networking & Wi-Fi Support
Networking or Wi-Fi troubleshooting visits will be chargeable at ₹1500 per visit unless explicitly included and billed under this AMC contract.
13. Support for Older Systems
Systems older than 8 years will receive remote support only. Replacement is recommended.
14. Termination
Either party may terminate this Agreement by providing 30 days’ prior written notice. In such cases, a refund of 50% of the unutilized AMC amount, calculated on a pro-rata basis for the remaining period, shall be applicable. No refund shall be provided if the remaining contract period is six (6) months or less.
15. Limitation of Liability
We shall not be liable for any indirect or consequential damages arising from service delays or failures.
16. Amendments
This Agreement may be modified or amended only by mutual written consent of both parties. Any such changes shall be valid only when documented and signed (physically or electronically) by authorized representatives of both parties.
17. Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this contract shall be subject to the exclusive jurisdiction of the courts in Mumbai.
